Frankly, I do not think that the ACLU Executive Director protesting Obama calling for indefinite detention without trial or, as his policy clearly allows, indefinite detention after a trial has found the defendant not guilty, is in the category of "knee-jerk invocations of civil liberties".

Obama specifically says he can keep indefinitely without trial people who "commanded Taliban troops in battle" even though the U.S. helped overthrow the Taliban government in Afghanistan. Peace treaties or overthrowing the enemy government have always in the past meant freeing enemy commanders.
